Garland Smith, Mediator

Mediation is a forum in which an impartial person, the mediator, facilitates communication between parties to promote reconciliation, settlement, or understanding among them. The mediator helps the parties communicate more effectively as they work toward a fair and equitable resolution that is mutually agreeable. Mediation is voluntary, private, and confidential. Unlike arbitration, a mediator does not
have the power to impose a resolution.

Do you have a dispute that you haven’t been able to resolve? Before going the litigation route, why not consider mediation? Mediation is an effective and efficient alternative that is worth considering.

There are several reasons why mediation is a viable option for resolving disputes:

  • Mediation is typically faster and less expensive than litigation.
  • Mediation allows the parties to maintain control over the outcome, rather than leaving it to a judge or jury.
  • Mediation encourages collaboration and open communication, which helps to preserve relationships between parties .
  • Mediation is private and less adversarial than court proceedings.
  • Mediation is a more flexible and creative way to reach a resolution than litigation, which is constrained by legal rules and procedures.

Taking another party to court is expensive, time consuming and stressful. It’s public. And there’s no guarantee that the court will rule in your favor. Consider mediation before you go the litigation route.
